Information brief on the treatment of your personal data, according to art. 13 of Legislative Decree n. 196/2003 with regard to the protection of personal data
We hereby inform you that for the fulfilment of the ongoing contract relationship with you, Flessya srl is in possession of data related to you, acquired also verbally, directly or through third parties, considered as “personal data” under Legislative Decree n. 196/2003 (so-called “Privacy Code”). According to said regulation, the subject treating this personal data must inform the concerned party whose data is being handled about certain elements qualifying the treatment, which however must be carried out with correctness, lawfulness and transparency, protecting your privacy and your rights. Therefore, according to the provisions of art. 13 of Legislative Decree n. 196/2003, Flessya srl supplies the following information:
NATURE OF THE TREATED DATA
The data subject of the treatment refers to your ordinary personal and fiscal data, in addition to financial data which is necessary to fulfil the ongoing contract obligations with your Company. We do not hold any data that could be considered as confidential or of judicial nature according to art. 4, paragraph 1, of Legislative Decree n. 196/2003.
PURPOSE OF THE TREATMENT
Your data is/shall be treated for the following purposes:
a) related to the commercial activity: Commercialization of data (collection and treatment of nominal data for marketing purposes); assessment of the customers’ satisfaction; marketing and advertising (market analysis and investigations; promotional activities).
b) related to the administrative-accounting activity: Management of customers (customers’ administration; management of contracts, orders, deliveries, invoices; control of the solvency); management of disputes (management of disputes, including credit collection); fulfilment of accounting or fiscal obligations.
The data shall be treated for the whole duration of the contract relationship and also subsequently for the fulfilment of legal obligations and for the above mentioned purposes.
METHOD OF TREATMENT
The collected data is/shall be treated with the use of suitable tools and procedures in order to guarantee its safety and confidentiality and can be done either on paper or with the help of electronic and telematic tools.
OBLIGATION OR FACULTY TO SUBMIT THE DATA AND CONSEQUENCES OF THE POSSIBLE REFUSAL
The submission of your data is: a) compulsory and does not need any explicit consent (art. 24, paragraph 1, lett. a,b) for anything which is requested by the legal and contract obligations and therefore any refusal to submit it or to treat it could cause the impossibility on the part of the present writer to fulfil the same contractual relationship; b) optional for anything which is not ascribable to legal or contractual obligations. The non submission of non mandatory data shall be evaluated each time by us and shall determine the relative decisions related to the importance of the requested data with regard to the management of the commercial relationship.
COMMUNICATION AND DIFFUSION
Notwithstanding the communications and diffusions for the fulfilment of the legal and contractual obligations, the data can be communicated in Italy and abroad only for the purposes of the technical-organisational management of the single commercial relationships and for the above mentioned purposes. In particular, the data can be communicated to: agents networks; factoring companies; credit institutions; credit collection and insurance companies; commercial information companies; professionals; consultants; companies working in the transport sector; other companies working in our sector.
RIGHTS OF THE CONCERNED PARTIES
In relation with the above mentioned treatments, the rights under article 7 of Legislative Decree 196/2003 could be exercised within the limits and on the conditions under art. 8-9-10 of the mentioned legislative decree.
Art.7. Right to access personal data and other rights
1. The concerned party has the right to obtain the confirmation of the existence or non-existence of the personal data concerning him/her even if not yet recorded and its communication in intelligible form.
2. The concerned party has the right to obtain the following indications:
a) origin of the personal data;
b) purposes and methods of the treatment;
c) logic applied in case of treatment made using electronic tools;
d)identification data of the titular, responsible person and representative designed according to article 5, paragraph 2;
e) the subjects or categories of subjects to whom the personal data can be communicated or who could become acquainted with it because of their position as designated representative in the territory of the State, responsible or appointed persons.
3. The concerned party has the right to obtain:
a) the update, correction or, if interested, the integration of data;
b) the elimination, transformation in anonymous form or the block of the data treated in violation of the law, included the data whose storage is not necessary in relation with the purposes for which the data has been collected or subsequently treated;
c) the proof that the operations under letters a) and b) have been brought to the knowledge of those whose data has been communicated or diffused, also with regard to the content, except for the case where this accomplishment is impossible or requires the use of means which are clearly disproportionate compared to the protected right.
4. The concerned party has the right to object totally or partially:
a) for legitimate reasons to the treatment of personal data concerning him/her, even though relevant to the purpose of the collection;
b) to the treatment of personal data concerning him/her for the purpose of sending advertising material or direct sales or for the performance of market researches or commercial communication.
